Kathmandu, 13 August 2026 — Ncell has strongly condemned the Government of Nepal’s decision to make public the “Ncell’s Share Purchase-Sale Related Study and Investigation Report, 2023 (2080)”, prepared by an investigation committee chaired by Tankamani Sharma Dangal.

According to the company, the Council of Ministers decided on 11 August to release the report, which was subsequently published through the Ministry of Information and Communications’ website on 12 August. Ncell argues that the publication disclosed sensitive information that should legally have remained confidential.

The company said the move violated its constitutional and statutory rights to privacy and confidentiality, including protections relating to property, documents, data, transactions and taxpayer information. It cited Article 28 of Nepal’s Constitution, provisions of the Individual Privacy Act, 2018, as well as confidentiality provisions under the Income Tax Act and Value Added Tax Act.

Ncell also claimed that a writ petition seeking the report’s publication had been dismissed by the High Court on 15 July 2026 and that the decision had become final. It argued that releasing the report despite this amounted to a serious failure to respect judicial decisions and the confidentiality determined by the court.

The company warned that the Government’s action could damage Nepal’s credibility among international investors and further weaken the environment for foreign investment. It described the disclosure as a breach of trust and confidence and said confidential information collected during an investigation should only be used by competent authorities for further investigation or prosecution, rather than being made freely accessible to the public.

Ncell said the publication had caused irreparable damage to the company and affected the rights of its shareholders, directors and stakeholders. It further stated that it reserves the right to pursue legal remedies, including possible claims for compensation under applicable laws.
